1. Who we are
PostCat is operated by Purrfect Wishes ("we", "us", "our"). By accessing or using PostCat (the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service. You confirm you are of legal age or have authority to bind the entity you represent.
2. The Service
PostCat lets you send animated meme-cat greetings to recipients you choose. Each send consumes one credit purchased through the Service.
3. Payments
Payments are processed by our payment provider Stripe on our behalf. All prices are listed in Australian Dollars (AUD) and are inclusive of applicable taxes where required. Purchases are one-off (no subscription) and grant send-credits to your account. Please review our Refund Policy before purchasing — all sales are final.
4. Acceptable use
You agree not to misuse the Service. In particular, you must not:
- use the Service for anything unlawful, fraudulent, abusive, harassing, or spammy;
- send greetings to recipients without a reasonable basis to believe they will welcome them;
- infringe anyone's intellectual property, privacy, or publicity rights;
- interfere with or probe the Service's security, or attempt to scrape, reverse-engineer, or bypass technical limits;
- upload malware or use the Service to distribute harmful code.
5. Your account
You are responsible for keeping your account credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.
6. Intellectual property
We retain all rights, title, and interest in the Service, including its software, design, branding, and the curated cat artwork. We grant you a limited, non-exclusive, non-transferable right to use the Service to send greetings for personal or internal business use. You may not resell, redistribute, or sublicense the Service.
7. Your content
You retain ownership of the messages and recipient information you submit. You grant us a limited license to host, transmit, and process that content solely to provide the Service.
8. Service availability
The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9. Suspension and termination
We may suspend or terminate access if you materially breach these Terms, fail to pay, create security or fraud risk, or repeatedly violate our policies. On termination, your right to use the Service ends immediately.
10. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amount you paid to us in the twelve months preceding the claim. We are not liable for indirect, consequential, incidental, special, or exemplary damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded under applicable law (such as fraud, death, or personal injury caused by negligence).
11. Indemnity
You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
12. Changes
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which Purrfect Wishes is established, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of that jurisdiction.
